Per half year accounts 31/12/13, '...ATO have determined a fair value of $56,300,000...' for MCC and so levied tax liability. On this basis, tax payable re MCC already provided and IMO, paid.

All that remains re ATO is hideous penalties which require somebody to establish that CFE deliberately set out to avoid tax. Tough ask and given consequences,(jail time, $30m outgoing) unlikely to find anyone fessing up IMO. On this basis, no resolution soon unless ATO significantly reduce scale of penalty and so implication of penalty.
