Compulsory Surrender Provisions and Iron
Ore Exploration
Section 65(1a)(a) gives the Minister discretion
to grant exemption from compulsory surrender
for tenements authorised to explore for iron ore
pursuant to section 111.
Industry is reminded that authorisation under
section 111 to explore for iron ore is not
sufficient reason in itself to qualify for
compulsory surrender exemption. If the
exemption criteria in section 65(1a)(b) is not
met for tenements authorised to explore for
iron ore, then the merits of section 65(1a)(a)
will be considered, based on issues such as
whether exploration is demonstrated to be
primarily for iron ore, existence of an iron ore
resource and any future likelihood of inclusion
into a State Agreement.
