Not quite, the court must approve any settlement and if it finds it's not fair no approval. CA members can make application the settlement is unfair and ask the court to disapprove. SGH management was not smart enough to have adequate insurance and should not be let off the hook for just $4M after causing a $2 billion dollar SH loss.
