ACCC has a better reputation to taking action for consumers. The more heat now the better to warn of a further attack in the future as past regulatory action and fines didn't stop the current situation. A company with priors is more likely to have action taken against it and greater deterrent penalties for recurrent breaches. Just a view worth thinking about.
