I agree, my post 9472830 earlier in the day included that point, whilst the sp has well and truly allowed for a loss, coming up with the cash is a different matter , perhaps the market is double discounting for the risk of a loss and cap raising. But the directors seem confident with their statement of no need for a raising in 12 mths.
From the statement of claim and response that I have seen and IF there is substance to NXSs statement re: Rig Cert and particularly the braking system then the market may just have it wrong. Regardless, hopefully both parties can settle it amicably beforehand. Bearing in mind if NXS lose 100% they can appeal anyway and payment suspended subject to continuing liquidated damages so immediate need for the money could be delayed.
Also Crux is 10% cheaper for a foreigner with the exch rate movement
