A month after the Sept 9 filing which was a draft filing of the CUP from Louisiana Department of Natural Resources, the final CUP is issued to satisfy this portion of Environmental Condition 18.
On April 30, 2014, Magnolia LNG LLC (“Magnolia”) filed an application under Docket No. CP14- 347-000 pursuant to Section 3(a) of the Natural Gas Act (“NGA”) as amended, and Part 153 of the Rules and Regulations of the Federal Energy Regulatory Commission (“Commission” or “FERC”), for authorization to construct, modify, and operate facilities used for the export of natural gas (“Project”). On April 15, 2016, the Commission issued its Order Granting Authorization under Section 3 of the Natural Gas Act and Issuing Certificates (“April 15 Order”) for the Project.
Environmental Condition 18 of the April 15 Order requires that Magnolia file with FERC documented approval of the final Beneficial Use of Dredged Material Plan as approved by the Louisiana Department of Natural Resources, Office of Coastal Management (“LDNR”). LDNR issued its Coastal Use Permit and Consistency Determination in draft form on September 9, 2016, and published the final approval on October 3, 2016. Magnolia hereby submits the final Coastal Use Permit and Consistency Determination to satisfy this portion of Environmental Condition 18.
