As also posted on the other thread, you would have to think it would be very hard to argue something that DISR had actually provided in advice to the JA's the last time. This document was included in the Court Bundle and it specifically refers to it "not a unique situation where exploration companies don't currently have the funds to as it is anticipated that he titleholders would be able to raise the capital required once the application has been granted".

I'm sure it wouldn't be too hard for DB's lawyers to investigate how many similar applications have been approved in the past, where the companies initially lacked funding but subsequently secured the necessary capital after receiving approval. Such evidence would render the argument against approval based on a lack of current funding entirely invalid.

As you rightly pointed out, the application must be assessed on its merits and not dismissed based on arbitrary or unfounded reasoning. This merit-based approach is further emphasised in the document, which states that, despite public opposition, "the Joint Authority has granted the titleholder a right to explore by issuing the title and must evaluate the application based on its merits."
