Im sure they have their bases covered as MOU's are not Formal Agreements in which damages can be claimed.
I think MMR are utlising the wording in the CTP's ann as a basis for their claim, and in some instances specific wording can actually constitute a contract.
Will be interesting to see what eventuates however I believe this one will be thrown out the door. Shallow attempt by MEC.
