The 5% claim relates to the second case (koh and Evans) who entered into a fund raising agreement with Nicu with these parties I understand promised to receive 5% of the assets for successful fund raising which I guess will be what case boils down to.
Primary case is seeking up to 100% of the IO assets.
The primary case or the second case will not disappear but if MMX pull this one off they get a share in MIS untainted assets and MIS get a share in Crosslands warts and all or in these circumstances cases and all.
