It is left to the Magistrate's decision. The fact that you are not "aware of any case .....etc" is no guarantee it has never happened.
A precedent exists where the offender has never been located, similar circumstances. Police must be so frustrated. Magistrate said left to the monitoring of the family - same family the 20-year old was seen laughing on the phone with at the scene?
