The silly thing is that even if the council signs this it still comes down to legal practicality.

If taken to the land and environment courts the council would lose. New mining in an existing mined area will result in approval whether they like it or not.

You have to have an absolute valid reason to say no, not just, i don't like it.

If a rail line was going through the main street or peoples health was going to be effected etc. Then they might have a chance.

Eventually it will come down to the Vic Gov not the local council. I think this is a classic example of local council thinking they have more power than they actually do.
