re: help 'bed & breakfast'? It all depends on your motive for doing this in my view. Lately the Commissioner has been very bullish with Part4a of the Tax Act and has been winning cases. The Courts have also expressed that if the dominant purpose is to seek a tax advantage then they will be inclined to rule its illegal.
If you think a share has performed badly you are entitled to sell it. However if you buy it back the very next day and show a pattern then isn't the Commissioner entitled to ask the question whether you have done this with a dominant purpose of seeking a tax advantage? I think so. Whether a Court then will rule for the Commissioner is another question. You read the cases on Part 4A of the Tax Act (the most recent being the split loan case on Heart) and self assess the situation.
