It might actually help PEN given that they talk about the new response ensuring a consistent approach (which would knock out any cowboys) and ensuring that everything is transparent in the process(I read this as aimed at heading off any public concern which might otherwise slow the process if it is dealt with properly and quickly by the govt). If PEN has its act together,and it seems to, this announcement should see it in a better position than some others to comply more quickly. I like two other things about it, the first being that they expect to deal with the applications in the next 2 years - not a long timeframe anyway, the second being that South Dakota is in as well (nothing to do with PEN but PMH has a nice little project in N.Dakota which might move along a bit faster once ND has some guide to how to handle these sorts of projects which are new on their radar).
