If you have 2 parties who can each play by these different rules, i.e. able to buy / sell in the sweet spot between where the rest of us can trade and thereby not have to get in the queue, they could make an arrangement to do this sort of deal and split the resulting profit 50/50, couldn't they?

You will also find that they pay much less for brokerage than we do assisting them greatly with their BOT trades of only a few shares.
