DB, you are confusing the legal right to PE with the ability of the seller to offer rights to PE even when not legally required to.FAR didn't put up their hand and say they would PE, they requested a new notice with a reset time frame. The court found that there was no PE rights legally required in the sale under the JOA.
FAR tried to play silly buggers to buy time and find a backer, but COP & WPL chose not to dance to FAR's tune. A PE notice is a legally binding offer to the JV, quite simply for a 30 day windrow FAR had the right to PE even if the JOA didn't require it.
