I think it is highly unlikely that Pomerantz will continue with this case.

I was recently involved in a class action case against Corporate fraud by a company in London. My lawyer needed 3rd party insurance against the claim failing in order to to cover their costs. The insurance provider is paid on a percentage of the successful claim. The class action was eventually dropped as the insurer hiked up the value of claims required in order to provide insurance. I don't know the level of claims required but I know my own loss was well into six figures. I would guess the more dubious the class action the more the insurer would require.

I don't know how it works in the States but based on my experience in the UK I would be very surprised if this class action were ever to get to court.
