MSB to dispute FDA finding in Type A meeting, page-566

Strategic? Wow. Lawyers equate to hopelessness here, IMO.

I've read your previous stuff - You would have us believe that MSB are posturing future legal action against the FDA? And this will have an impact on the FDA - oh really? As a lawyer you would like to think so! Check your ego!

1. The FDA knew what their response was prior to handing it down to MSB, obviously. Naïve to think that they are not prepared for MSBs next steps before they handed down their recent response.
2. This is not the FDA's first rodeo.
3. Mesoblast: Legal water pistols. FDA: Legal nuclear weapons. American legislation will change to protect the FDA (extremely unlikely to happen for MSB).
4. Don't get me started on the industry that thrives on 'interpretation'.

My thoughts: The tracks weren't greased well enough. The right beaks weren't wet. Lawyers and legal proceedings won't fix this - the second legal action gets tabled, I'm out of Mesoblast - vultures circling.
