Could still backfire on novartis if your reasoning is correct.
CHF result means other big pharma are probably making enquiries to msb management.
If deal for CHF is acceptable from one of those then msb can insist novartis pay first $50M on time or cancel novartis deal and keep all ards and gvhd for themselves or partner with another!
So msb management have the upper hand in negotiations.
