Yes! From what I can see, MSB is getting this out of the way to line up for a review on the merits.
In the US a review can be done which the court substitutes its decision for that of the authority. That is another way that administrative law is more developed in the US. They have a more interventionist judiciary.
This is my understanding about the substance. Happy to be corrected if I have this wrong.
I would imagine that MSB senior lawyers and Board members are quietly seething at the manifest incompetence and absurdity.
Not that they'd ever say that.
