The other very important inclusion in the contract with Novartis is the bit about being subject to that legislation that delays the deal for 30 days. The purpose of this is not simply a 30 day cooling off period, it is to give time for the American government to insure the interests of the American people are not undermined by large corporations . They would be looking very hard at this deal. Indeed it could well be why the closing of the deal has been delayed. It may not have any thing to do with the ARDS trial.

I believe that the ARDS trial being stopped early was simply convenient timing and a distraction from what actually is happening behind closed doors. The outcome of the ARDS trial was not going to prevent this partnership from being closed. We could have been still recruiting patients for this trial and the deal would now be closed. Something else has delayed the closing of the deal.
