I think that the evidence is all but conclusive. Novartis most probably had substantial influence over the FDA.

This however is not any breach of due processes. The FDA realise on the input of outsiders including big pharmaceutical companies.

Now considering this, the Novartis partnership and that last bit of the announcement , "subject to ..." This is not just a cooling off period. The purpose of this is to insure that large corporations do not abuse there power and unfairly hold small companies to ransom. So we can now establish that we have a independent party review underway if not complete. Can you imagine what would happen if they ruled FDA was overwhelmingly influenced by Novartis and as such the FDA should have backed there own ODAC panel and approved our therapy.
