I took it to possibly mean the same thing... however, you have to take it in the context of an investor call with the tension of that trigger hanging over NC.
I am of the opinion that, if the TOL does not arrive before that date, MK could (and would) argue that they could reasonably use the trigger... I suspect they will have to argue it in a court however. I know that I certainly would if I was in their position.
