I have been following this case carefully over the past 18 months and tend to agree with your synopsis from the limited information made available to the public.

Question is.......why do investors continue to buy this stock at current levels in light of this uncertainty?? I closed my 200k of shorts out in April but have been surprised by the steady rise north since.

Are you willing to disclose the size of your short sell position? The company has 3.858m shares short sold as of yesterday (representing 4.6% of shares allowed to be sold short). I assume you are responsible for ther majority of that? Lol
