Svenska brottsbalken (SFS 1962:700)

Bestämmelserna om mutbrott återfinns i brottsbalken, 10 kap. 5a-5e §§ och innebär i huvudsak följande:

3. Det är inte tillåtet att ta emot, godta ett löfte om eller begära en otillbörlig förmån för att påverka någon som utövar myndighet eller beslutar om offentlig upphandling eller att lämna, utlova eller erbjuda en otillbörlig förmån till någon för att denne ska påverka beslutsfattaren vid myndighetsutövning eller offentlig upphandling

(It is not permitted to receive, accept a promise of or request an improper benefit in order to influence someone who exercises authority or decides on public procurement or to give, promise or offer an improper benefit to someone in order for him to influence the decision maker in the exercise of authority or public procurement)

Village funds / village money can be bribes
What are bribes?
Taking into account the the exploiter's agreement on funds prior to the decision on a permit for mining activities, according to the undersigned, a bribery offense is committed when someone accepts bribe(s). The receipt of a bribe does not necessarily mean that the giver actually benefits. Bribery is to leave, promise or offer an improper benefit to someone/some e.g. in Vittangi and/or Kiruna municipality. Even accepting a request to receive an improper benefit is considered bribery.

In the Svedish Mining- or Environmental Code, there is no support for charging compensation, in the form of "community funds/village money" for mining establishments and mining operations.

The provisions regarding bribery (crime of corruption) can also be found in the Swedish Criminal Code, chapter 17, section 7, chapter 17, section 17, chapter 20, section 2 and chapter 20, section 5.
