    The German court has to date taken a somewhat idiosyncratic (relative to US patent rulings) view of the 'prior art' aspect of the technology on which IPR pins its case so maybe that trend has continued here. Having now seen the full transcript of the TH request just released to the ASX, I agree that IPR's seeking legal advice does not bode well for an early settlement.

    It's a pity there is no internationally binding jurisdiction on patent claims of this kind. A ruling in the US is not binding in Europe, although one would imagine that judges in such cases are cognizant of the basis for the findings of their peers in other countries.

    I guess we'll just have to wait and see what this is all about. If it is an adverse finding from the German court, I suspect IPR is considering grounds for a fresh appeal.

    Troubling...
