    Bilal Skaf loses rape appeal

    NOTORIOUS Sydney rape gang leader Bilal Skaf lost two appeals today against his convictions for gang raping three teenaged girls in south-western Sydney in August 2000.


    22-year-old Skaf is awaiting the outcome of a third appeal.


    However, the NSW Court of Criminal Appeal overturned the conviction and sentence of Skaf's co-accused, Mohamed Ghanem, for a gang rape at Bankstown on August 2000 and ordered a retrial.

    Ghanem was sentenced to 40 years jail for two gang rapes. The court ruled telephone intercepts had been improperly admitted as evidence during Ghanem's trial.

    Skaf is yet to discover the result of another appeal based on an investigation into two jurors' experiments conducted at the scene of another gang rape during deliberations.

    His brother Mohammed Skaf is also awaiting a ruling on his appeal against his rape conviction over the same incident.

    Bilal Skaf, Mohamed Ghanem, Mohammed Skaf and Mahmoud Chami had all appealed their conviction for the gang rape of an 18-year-old woman at Bankstown on August 30, 2000.

    The young woman was attacked by 14 men over six hours at a Bankstown toilet block, Bankstown Trotting Club and a Chullora industrial estate.

    President Keith Mason, Justice James Wood and Justice Brian Sully allowed Ghanem's appeal because the trial judge allowed prejudicial telephone conversations between him and Chami to be admitted in evidence.

    The judges also ruled he did not give adequate jury directions on the telephone conversations once they were admitted.

    "They also tended to concentrate on Chami's perspective, without adverting to the hypothesis (supported by Ghanem's evidence) that Ghanem was doing no more than giving his friend a sympathetic ear," the judges said.

    Ghanem, Bilal Skaf and Belal Hajeid also appealed their convictions for the pack rape of a 17-year-old and an 18-year-old victim at Northcote Park, Greenacre, on August 10, 2000.

    All three men lost their appeals on the convictions for this attack.

    Bilal Skaf was sentenced to 55 years jail for a string of gang rapes in Sydney's south west in 2000.
