Toll continues ACCC discussions

Following discussions with the ACCC, Toll has accepted the ACCC’s invitation to revisit competition concerns expressed by the ACCC in its media release of 18 January 2006 with regard to Toll’s Offer to acquire Patrick Corporation Limited (“Patrick”).

Toll has agreed to certain procedural undertakings in order to facilitate its ongoing discussions with the ACCC.
Toll believes that the benefits of the acquisition of Patrick for shareholders and customers of both companies remain attractive and warrant Toll pursuing commercially acceptable solutions which can achieve regulatory approval without the need for lengthy
court action.

On the basis of the above, Toll intends to extend the period of its Offer for Patrick from 1 February 2006 to 7.00pm on 13 February 2006.
