Maredi Mphahlele says that the Roka Phasha community is pursuing legal action against the Bengwenyama. The Bengwenyama have confirmed that they have the letter.
I found this part of the Shapiro/Bengwenyama-Ya-Maswati article particularly interesting.
"Community made a rights application immediately after the Constitutional Court made its ruling."
If this is true, then this has given NKP no where else to go but to apply for their own rights with Roka Phasha and who ever their Beng is.
The trouble is that the Con Court now considers Bengwenyama-Ya-Maswati as the owners.(rightly or wrongly)
For the DMR to now give right with out Bengwenyama-Ya-Maswati included just does not seem feasible and will end up straight back to court.
If you check the Con court ruling, Bengwenyama-Ya-Maswati applied for rights way back in 04, but was ignored by the DMR.
(I still find it inconceivable that these right of ownership were not brought up in court considering everything hinge around it)
