Here’s a public redacted version of the states’ complaint for anyone interested in reading more.

The named pharmas stand accused of conducting a conspiracy called “Playing Nice in the Sandbox”, whereby they agree to divide up drug markets so that each is apportioned its “fair share”.

It does make me wonder whether the rules of “Playing Nice in the Sandbox” might not also apply to daptomycin iv. Perhaps it is “understood” by Mylan that there are already too many players in the sandbox?

It is stated in the complaint that there is a shared understanding that competitor pharmas can “reach out to each other with the expectation that they would be able to reach an agreement….”

That sounds to me like the type of understanding and skill that would be perfect for reaching settlement in an arbitration settlement…
