The Agila European patent for an improved daptomycin injectable [EP2887953] was filed on the 22/8/2013 and published on 11/10/2017/.Within the patent Agila states that the TPM mixture was an IH developed TPM formulation.I have taken that to mean the TPM formulation was developed "in house" and has no relationship to the POH daptomycin injectable. The Agila TPM solution was said to be an antioxidant as well as a stabilizer.
Given that this same patent was deemed not patentable in the US it appears that Agila have pretty much just copied the POH formulation for their own injectable in this instance.
Mylan has had years to terminate this activity but have not so in my view Mylan want this patent processed.
