NAMIBIAN APPEAL FINALISED
The Company has received confirmation from its lawyers in Namibia that the Registrar of the
Supreme Court of Namibia has formally rejected the attempt by the legal representative of Mr
Malakia Amakutuwa to file a further appeal or review of the Supreme Court?s judgment of 5
November 2010.
In that judgment, the Supreme Court unanimously ruled that Metals is the true holder of
prospecting rights for uranium on EPLs 3306 and 3308.
Following the judgment being delivered, Mr Amakutuwa, the unsuccessful respondent in the
appeal, sought to challenge the appeal judgment despite the fact that the Supreme Court is
Namibia?s highest court and its judgments are final.
The Supreme Court judgment also binds the Minister of Mines and Energy, who had been
joined as a party to the proceedings by Mr Amakutuwa.
The Registrar?s letter to Mr Kasuto, the lawyer for Mr Amakutuwa, was received by the
Company from its Namibian lawyers on 10 January, and a copy is attached.
Welcoming the news, Metals Chairman, Mr Sol Majteles, said: ?We are delighted that the
Registrar has now formally rejected the attempt to challenge the Supreme Court?s final
judgment. Our Senior Counsel has also confirmed that this now ends the attempt to frustrate
implementation of the judgment.?
A letter was delivered to the Ministry of Mines and Energy on 10 January 2011 attaching a
copy of the Registrar?s letter and requesting that the renewal of the two EPLs be processed
without further delay.
The Company now looks forward to the renewal of the two tenements and the
commencement of an aggressive exploration programme
