Actually, I've read most of the bill and it clearly spells out that the Bill cannot circumvent Native Title.
What this challenge says to me is that negotiations between the JV and the Native Title holders are still on tenterhooks.
The bill does however have provisions which will enable speedier resolutions to Heritage issues for the JV. At least that's the way I read it, but I'm no lawyer, so take this with a grain of salt.
