Nearmap v Spookfish preliminary discovery

    NEA's legal action against SFI for preliminary discovery (ie disclosure/ production) of documents that might show infringement of NEA's IP is heard on 19 March at the Supreme Court in Sydney.  A two day court hearing has been scheduled. There is no legal claim for IP infringement yet (and maybe never). If successful in their application, NEA will get to look at SFI correspondence and communications and other documents. If NEA thinks these evidence an infringement of its IP rights then it may choose to sue SFI. So they are just asking the court to order SFI to show them what they have got. Nothing more at this stage. But still 2 days to hear the legal arguments!  Don't know if judge will give judgment at the end of it or, more likely, if he/she "reserves" judgment for another day. This can mean a wait of several months.  The judgment when given will get published online. I'm sure NEA won't delay in telling us the outcome if it is favourable.
