"The debt is currently at US$50m, payable on 18 February 2009 and is owed by SCM Vallenar, not the minority shareholder, Wyndham Explorations S.A.
If the loan is not repaid by Vallenar and Wyndham can’t serve its proportion of the debt, Admiralty will submit a request to enforce the Fixed and Floating Charge. In that event, it may be that Wyndham doesn’t agree with Admiralty’s decision and the case will go to an arbitration process, conducted under the laws of England."
