My bet is the agent is receiving a higher commission base once the offer hits over $350k.

Actually forget that idea, although slightly humorous.
Tell him you have been pre-approved via your bank at $344,556 max (yes use a wierd number like it has some science behind it) and tell him the bank wont allow you to go any higher due to your in-ability to service a higher loan based on your current income level.
