How deterministic is the expert determination? Let's not have possibly undue expectations.
Arbitration result is not necessarily binding but it may be inclined to favor one parties' view or straddle both as right, it comes down to who is exhausted or has the stamina to escalate or goodwill based on arbitration, to agree to a resolution.
I think another poster pointed to a Supreme Court ruling on an ROFR they were involved in.
