Okay - this is getting interesting. The fact that we have had no announcement is very telling- but in a good way!

We know the Phospha-E Nestle trials were completed by end of 2008 and that results (depending upon the time taken to analyse the data points generated during the study) were to be complete soon after...so lets say early march to be conservative.

In the 08 Annual report- tabled mid last month - well after the trial results were tabulated, Andrew Vizard wrote in his Joint Chairman/ CEO report about the Nestle results triggering a deal on back of successful trial results.

So at that point in mid April- with results in hand ( and with knowledge of the markers the trials needed to hit ) Directors were bullish on a Nestle deal. This is significant and we can reasonably conclude to be fact.

Next all that was needed was for Nestle to tick the trial results and sign a nice little deal with POH that was drafted back in 2007.

So here we are mid May and no ann. Whats going on?

Would Nestle have the data in their hands - categorically yes- they funded the trials for over 2 years- and the responsible Nestle personal would have been all over POH at the end of trials.....plus they would no doubt been informed of progressive results during the trials...after all Nestle were funding the trials entirely.

Did the trials flop ? - POH has never had a trial fail - and if the trials were inconclusive or a dissapointment to Nestle- then Nestle would by now have rejected the deal and POH would have made an ann that we have no deal!

So why the silence from POH? I have a theory!

What if the trials have thrown up better than expected results. (consistant with every set of clinical trials POH has completed) .

You will recall that POH ann back in Feb 2008 to the ASX that Nestle were interested in using Phospha-E in medical foods to fight metabollic syndrome.

The aim of these trials broadly was to demonstrate that Phospha-E can lower cholesterol & triglycerides and prevent formation of plaque in heart arteries - thereby combating metabollic syndrome- one of the biggest killers in western societies. ( POHs own early trials demonstrated this in two pre-clinical studies where Phospha E® significantly reduced LDL ("bad") cholesterol & triglycerides and prevented plaque formation by up to 60%)

But what if the trials showed greater than expected beneficial results in improving heart health. What if the benefits of Phospha-E in reducing bad cholesterol were such that in a different a non medical formulation Phospha-E could be easily added to Nestles wider consumer food products? We have discussed this on this thread- but it was as hypothetical.

I suspect that this is where we are at- in which case the lawyers are hammering out a new contract worth much more to POH - thoughts anyone?
