The business itself is based overseas, meaning it's a non-local entity. As a non-local entity it would actually be against the law for Netflix to collect GST. Yes, they could have set up a local entity, but why would they? There's no benefit to the business.
Customer are not buying content, they are buying a subscription. This subscription is a US product.
