"Thank you for your email.  As advised in the recently released quarterly report, Lynas was aware that the individuals who initiated the unsuccessful 12 April 2012 judicial review proceedings would appeal the court’s decision in that matter.  Lynas was not party to the procedural application to seek leave to apply for the judicial review and no subsequent hearing dates were set to hear the merits of the review application.  The proceedings are not a challenge to the AELB’s decision to approve the TOL.
 
Lynas are in close and regular contact with the Malaysian government concerning the Temporary Operating Licence.  We have made all our submissions to satisfy the conditions of the TOL.  We confirm that the equity market remains fully informed of all material developments relating to the company and we will update all shareholders through ASX announcements of future material developments as they happen.
