"Extremely hard - nigh impossible - to believe $MYX.AX gave this explicit “guidance” to the bidder without giving it to the market as well (which they clearly didn’t)." - It would seem to me that for the Yankies to win here, not only do they need to prove that MYX moved the needle on them from an explicate guidance, but that MYX broke ASX discloser rules, by not telling the market of this explicate guidance. I too, just like Raper, find this very hard to believe. Always do what the late Munger did, invert a problem. If this did occur, and it was a 100% explicate guidance, then why has Yankies never disclosed this to MYX in their original MAC breach letters. If this did occur, then why did the Yankies not bring this up prior to the first court hearing where they stood up and said all is Kosher then literally a few days later sent MYX a MAC breach letter (I think it was a Sun and court was on Friday)!
