    Some comments from an"amateur".

K&A are using the media as an informal communication tool to keep the pressure on .The Observer appears to be their mouthpiece cf with The Namibian which appears to be more balanced with its coverage.

The article presents only K's perspective.

The Supreme Court has already rebutted much , if not all that is attributed to K in this article.

IMO K knows that they can't win and this is a desperate move to try to get a compromise .

"THERE appears to be no end in sight in the court battle between Australian mining company Metal Australian Limited and businessperson Malakia Josef Amakutuwa over the ownership of two exclusive prospecting licenses (EPLs) for uranium in Namibia."
My interpretation :Do a deal or this is going to go on and on.Lacks substance IMO a bluff.

"The beleaguered Supreme Court has increasingly come under the cosh from various quarters in recent months over what some consider highly marginal judgements"
My interpretation :Let's try to undermine the credibility of the Supreme Court and gain some credibility for A's case at the same time putting some pressure on the Court to seek a way out of a sticky situation.

"Kasuto maintained that the second agreement on which the appellants based their appeal to Supreme Court was illegal.....Thus, the objection was that this point [of the amendment to the second agreement] was not raised in the High Court and it cannot be done in the Supreme Court, Kasuto argued in the letter. "
My intrepretation :The Court made a huge mistake ,therefore my position is justified. There is a big question about its credibility.

"They have argued that the judgement that was prepared by South African-national, Justice Kate ORegan was based on new evidence that was never part of arguments in the High Court judgement and on which the appeal was based."
My interpretation ;It wasn't our local boys that were incompetent...it was that racist SothAfrican white judge ...and she is a female to boot (and probably a mate of that troublemaker Obelix (lol)) .
"A legal expert, who requested the newspaper not to mention his name, said the decision by the Court of Appeal raises many questions. "
My interpretation :A mate of mine wanted to help out ...but he wanted to hide while I put my hand up his back and moved his lips .
OR , I looked in the mirror and moved my own lips .

"I think one of the possible routes is to call the two parties to the table and try to settle the matter, the lawyer said."
My interpretation :Did I say that ..someone's moving my lips again!
Code for :We are done , we know it ,but we playing a bluff.
Come to us and we will do a deal. Its your only way out of this maze.
IMO:I think the Court will not want to get involved in any deals ..it will want to clearly rebut any attack on its integrity and/or competence.A very dangerous card for K to play imo.

"ORegan also played down Amakutuwas assertion that the two companies pressured him with threats of litigation to sign the second agreement."

    IMO :That bitch was biased.
Forget the fact that 2 other Namibian colleauges agreed with her !!

IMO there is a game being played out ithrough the media.
It is not in K's interest for no-one to know what is happening.
I think that they realise that some sort of buyoff is there only hope .Not a strong hand imo.
I would hope that the Court would be VERY upset by some of the inferences in the article and move quickly to stamp its authority ..particularly over K.
    Just my thoughts .
    Regards
    Q
