You have to wonder why bring this up if your legal advice is that there are no preemptive rights! I know you shouldn't trust what reporters write because they invariably misquote but this is the second article with that quote. If PC did make this statement it appears that he is not 100% certain that a preemptive right does not exist and the battle lines may be drawn using the financially and technically competent argument. Works fine if FAR only has access to PE but if the backer is a big major then that's another story.
