Who is the INDEPENDANT that decides who is financially and technically capable? Surely it's not left in the hands of the JV partner selling or the purchaser to decide this all important fact? Perhaps it's requires a majority of the Jv partners to determine, which would imply that CNE were approached and perhaps offered a sweetner to roll over on far? The truth will come out eventually. It's annoying there are so many unknown unknowns in this.
