Directors have a duty not to trade insolvent
The Dec 31 cash balance was zero. No offer of finance has ever been announced by MRV since the march offer of funding from Feitelson, perhaps that offer has been rescinded.
Other than from some of the Directors the Company did not appear to have access to any liquidity.
No Dec 31 financials means a rights issue was impossible and the Company had no market relationships to do a placement - and literally no executive management team left in head office to back either. And as I have noted in earluer posts, at some point FS' patience was bound to fun out - i guess now it has or they would have offered them another convertible I guess.
So again, access to what financing?
