"so your suggesting because the victim got lucky and didn't suffer more serious injuries/death Packer's crime is not as bad?"
Yes Wantoretire, I am suggesting that. I'm no brain surgeon but if someone dies from an incident while another person lives, i'd say the "death" incident is worse. That's why the law has "murder" and "attempted murder" with varying degrees of punishment.
A king hit causing death will always be treated differently to a king hit causing minimal damage. I suppose it depends on luck and the damage to the victim. A person driving drunk and injures someone is going to be treated differently to someone who kills someone. It is how the law works.
As i alluded to in my post, it is about time harsh punishments are handed out, as long as they are consistent. The king hit death should have been at the high range of manslaughter (max of 20 years i think), not at the very low. He should have got 15 to 16 years and I would have been happy to see Packer get the maximum for whatever he was charged, even attempted murder, which i think "stomping" is.
Head stomping seems to be all too common with a certain group of people, so it is a good message being sent.
