The losers in this so-called 'loophole' are the incumbent banks who're still banking on the revolving debt concept that was the best option in the past.
The winners are merchants who've so far voted with their feet that BNPL benefits have more than justified the costs as it's a free economy as far as I'm aware, and data shows customers love it. Of course BNPL firms are winning too.
