Not sure which announcement you are reading but to waive the need for the ML tells me that either CATH knows the ML will eventuate or they are supremely confident. You don't cancel an important clause like needing an ML in an agreement when you are dealing with 240m.

Don't think it is like a sportsbet soccer game. More like a property investor waiving the need for a finance and pest/building inspection clause so they can get their highly prized home over others.
