Sorry Farmboy, but I disagree with your post.
Firstly, to my knowledge TPI only carries ore for BC Iron which is a joint-venture partner of FMG and not an independent 3rd party producer.
Secondly, Brockman participated in direct negotiations with FMG/TPI for years before taking this legal course of action.
Thirdly, Brockman strongly denies TPIs arguments about its financial situation and its ability to operate a mine (and to operate its own trains).
I believe that these these arguments were put by TPI but obviously didn't convince the court.
