For FID to be announced before the PE result is known WPL must have certainty their 35% is secure. FID triggers all the development orders that are currently on hold.
On that basis WPL will either know Declaratory relief is not going to be awarded, or if it is they have agreed a cash settlement with FAR not to exercise their PE rights should they be allowed to do so.
Also for the Development Plan to be approved WPL must be securely positioned in the JV.
