Here is one historical example of the type of behaviour.

    https://www.accc.gov.au/media-release/court-finds-coles-engaged-in-unconscionable-conduct-and-orders-coles-pay-10-million-penalties

To be clear, this is just an example. I can’t imagine GAP supplies much to Coles. Whether such activity has occurred with a retailer GAP supplies only they would know. In my first post I mentioned the possibility it could even be a US customer.

But when a company makes an announcement regarding an significant unforeseen provision for customer incentive at this stage of the reporting cycle it sounds to me like more than a bit of retail negotiation. GAP has been dealing with their customers for many years, just how unforeseen should a multi-million dollar incentive provision be at this point in their relationships.

It’s possible I guess that someone wasn’t aware or accounting for a provision in an existing agreement but if true that would be a complete shocker from the company.

To some extent it comes down to your interpretation of the word unforeseen.
